Terms of Use
1. The Service
SafeArrive is an automated child arrival safety alert system provided by SafeArrive LLC, a California limited liability company ("SafeArrive," "we," "us," or "our"). The service notifies parents and emergency contacts when a child has not arrived at school or camp by a designated cutoff time.
SafeArrive is a notification and communication tool. It is not a guarantee that every child will be accounted for in every circumstance. Schools and administrators remain responsible for their own safety policies and procedures.
2. Who May Use the Service
SafeArrive is available to schools, preschools, daycares, nurseries, and summer day camps. By subscribing, the school administrator represents that they have the authority to enter into this agreement on behalf of their institution and to enroll children and families in the system.
You must be at least 18 years old and legally authorized to act on behalf of your organization to create an account.
3. School Administrator Responsibilities
As a school administrator, you agree to:
- Obtain appropriate consent from parents and guardians before registering their children and contact information in SafeArrive
- Ensure that all information entered into the system is accurate and up to date
- Promptly notify us of any data errors or security concerns
- Use the service only for its intended purpose of child arrival safety
- Not share admin login credentials with unauthorized individuals
- Revoke teacher or staff access immediately upon termination of employment
4. Subscription and Billing
SafeArrive is offered on a monthly or annual subscription basis. Pricing is based on the number of enrolled students or campers as described on our pricing page. Annual plans are billed once per year and include two months free compared to monthly billing.
Billing is processed by Stripe. Your subscription renews automatically unless cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period. No partial refunds are issued for unused time within a billing period.
We reserve the right to update pricing with at least 30 days written notice to active subscribers. Founding school pricing is locked as described in your subscription confirmation.
5. Free Trial
Founding schools receive the first 30 days of service free of charge. Founding camps receive the first week free. No payment information is required during the trial period. At the end of the trial, you will be asked to provide billing information to continue service.
6. Limitation of Liability
SafeArrive is a supplemental communication tool. It does not replace the safety policies, supervision responsibilities, or emergency procedures of your school or organization.
To the fullest extent permitted by law, SafeArrive LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the service, including but not limited to any failure of an alert to be delivered due to technical issues, carrier disruptions, incorrect contact information, or other factors outside our control.
Our total liability for any claim arising out of or relating to these Terms or the service shall not exceed the amount you paid to us in the 12 months preceding the claim.
7. Service Availability
We make reasonable efforts to keep SafeArrive available and operational during school hours. However, we do not guarantee uninterrupted service. Scheduled maintenance, third-party outages (including Twilio), and other factors may occasionally affect availability. We will communicate planned downtime in advance where possible.
8. Data and Privacy
Your use of SafeArrive is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We handle all personal data in accordance with our Privacy Policy and applicable law.
9. Termination
You may cancel your subscription at any time through your account or by contacting us. We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice depending on the severity of the violation.
Upon termination, you may request an export of your school's data. Following export, we will delete your data upon written request.
10. Intellectual Property
All content, software, and technology that makes up the SafeArrive service is the property of SafeArrive LLC. You may not copy, reverse engineer, or resell any part of the service.
11. Governing Law
These Terms are governed by the laws of the State of California. Any disputes arising under these Terms shall be resolved in the courts of Los Angeles County, California.
12. Changes to These Terms
We may update these Terms from time to time. We will notify school administrators of material changes by email at least 14 days before the changes take effect. Continued use of the service after changes take effect constitutes acceptance of the updated Terms.
